Service Agreement

1. Parties

This Service Agreement ("Agreement") is entered into between:

Service Provider: AWRW Enterprises, LLC d/b/a Wise Forensic ("Wise Forensic"), operated by Andrew Wise, located in Glendale, Arizona.

2. Scope of Services

Wise Forensic provides digital forensic examination and analysis services for personal electronic devices, including but not limited to computers, laptops, tablets, and mobile phones. Services may include:

  • Forensic imaging and preservation of device data
  • Recovery of deleted files, messages, photos, and application data
  • Analysis of browsing history, communication patterns, and app usage
  • Detection of hidden applications, accounts, and encrypted content
  • Delivery of a written findings report with supporting evidence

The specific scope of each engagement will be agreed upon during the initial consultation and documented on the accompanying Consent Form.

3. Authorization Requirement

Wise Forensic will only examine devices for which the Client has legal authorization. The Client must complete and sign a Device Ownership/Authorization Consent Form or Parental Authorization Form prior to any forensic work being performed. Wise Forensic reserves the right to decline any engagement where legal authorization cannot be reasonably established.

4. Service Limitations

The Client acknowledges and agrees that:

  • Wise Forensic provides forensic analysis services only and does not provide legal advice. The Client should consult an attorney for legal matters.
  • Wise Forensic will not access devices, accounts, or systems that the Client is not legally authorized to access.
  • Wise Forensic does not guarantee the recovery of all data. The ability to recover data depends on the device, its condition, and actions taken prior to analysis.
  • Wise Forensic does not install monitoring software, spyware, or tracking tools on any device.
  • Wise Forensic will not tamper with, alter, or fabricate any evidence or findings.
  • Findings reports are provided for the Client's personal informational purposes and may not be suitable for use as evidence in legal proceedings without additional expert testimony.

5. Confidentiality

Wise Forensic will maintain strict confidentiality of all information obtained during the course of any engagement. Wise Forensic will not disclose any findings, data, or client information to any third party except:

  • With the Client's prior written consent
  • As required by applicable law or court order
  • To report suspected child abuse, exploitation, or trafficking to appropriate authorities as required under Arizona law (A.R.S. Title 13, Chapter 35.1)

6. Payment Terms

All fees are due at the time of service unless otherwise agreed in writing. Accepted payment methods include cash, Zelle, Venmo, and major credit cards via Square.

  • Cancellation: Appointments cancelled with less than 24 hours notice may be subject to a $100 cancellation fee.
  • Refunds: Once forensic imaging has begun, fees are non-refundable, as the service has been rendered regardless of findings.
  • Additional work: If the scope of analysis expands beyond the original agreement, Wise Forensic will provide a revised quote for Client approval before proceeding.

7. Limitation of Liability

Wise Forensic's total liability to the Client for any and all claims arising out of or related to this Agreement shall not exceed the total fees paid by the Client for the specific engagement giving rise to the claim. In no event shall Wise Forensic be liable for any indirect, incidental, special, consequential, or punitive damages.

8. No Guarantee of Outcome

Wise Forensic makes no guarantees regarding the outcome of any forensic analysis. The Client understands that analysis may reveal no noteworthy findings, or may reveal information that is unexpected or distressing. Wise Forensic reports findings objectively and without bias.

9. Independent Contractor

Wise Forensic operates as an independent contractor. Nothing in this Agreement creates an employer-employee, partnership, joint venture, or agency relationship between Wise Forensic and the Client.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona. Any disputes arising under this Agreement shall be resolved in the courts of Maricopa County, Arizona.

11. Entire Agreement

This Agreement, together with the applicable Consent Form(s), Privacy Agreement, and Liability Waiver, constitutes the entire agreement between the parties. No modification of this Agreement shall be effective unless made in writing and signed by both parties.
