This Liability Waiver and Release ("Waiver") is entered into between AWRW Enterprises, LLC d/b/a Wise Forensic ("Wise Forensic") and the undersigned Client ("Client") in connection with digital forensic analysis services.

1. Assumption of Risk

The Client understands and acknowledges that digital forensic analysis involves inherent risks, including but not limited to:

  • Discovery of information that may be unexpected, disturbing, or emotionally distressing
  • Discovery of information that may have legal implications for the Client or other parties
  • The possibility that no significant or relevant findings may be discovered
  • Potential changes to device metadata as a result of forensic imaging, even when proper forensic methods are employed

The Client voluntarily assumes all risks associated with the forensic analysis and the information that may be revealed.

2. Limitation of Liability

To the fullest extent permitted by Arizona law, Wise Forensic's total liability for any claims arising from or related to the forensic services provided shall not exceed the total fees paid by the Client for the specific engagement. In no event shall Wise Forensic be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of income, revenue, or business opportunities
  • Emotional distress, mental anguish, or psychological harm resulting from the findings
  • Actions taken by the Client or any third party based on the findings
  • Damages arising from the Client's use or misuse of the findings report

3. No Warranties

Wise Forensic provides forensic analysis services on an "as-is" basis. Wise Forensic makes no warranties, express or implied, including but not limited to:

  • Completeness of data recovery (some data may be unrecoverable due to encryption, overwriting, device damage, or other technical limitations)
  • Accuracy of recovered data that may have been corrupted prior to analysis
  • Fitness of findings for any particular purpose, including use as evidence in legal proceedings
  • Specific outcomes or results from the forensic examination

4. Data Integrity

Wise Forensic employs industry-standard forensic methods to preserve data integrity, including the use of write-blockers and forensic imaging. However, the Client acknowledges that:

  • No forensic method can guarantee 100% preservation of all data or metadata
  • The condition of the device prior to analysis (damage, tampering, factory resets, encryption) may limit what can be recovered
  • Wise Forensic is not responsible for the pre-existing condition of any device

5. Emotional Distress Acknowledgment

Important Acknowledgment

Digital forensic analysis may reveal information that is deeply personal, graphic, or emotionally distressing. This may include evidence of infidelity, explicit communications, inappropriate relationships, illegal activity, or other sensitive content. The Client acknowledges that Wise Forensic cannot control what is found on a device and that the Client has voluntarily chosen to proceed with this analysis. Wise Forensic is not liable for any emotional distress, relationship consequences, or psychological impact resulting from the findings.

6. Use of Findings

The Client assumes full responsibility for how the findings report and any associated data are used after delivery. This includes:

  • Any decisions made based on the findings (personal, legal, or otherwise)
  • Any actions taken against other parties based on the findings
  • Sharing the findings with third parties (attorneys, family members, etc.)
  • Any legal proceedings initiated or influenced by the findings

Wise Forensic provides factual findings only and does not advise the Client on what actions to take. The Client should consult appropriate professionals (attorneys, counselors, law enforcement) for guidance.

7. Legal Proceedings

The Client acknowledges that:

  • Wise Forensic's findings reports are prepared for informational purposes and may not meet the evidentiary standards required for court proceedings without additional expert testimony
  • If the Client wishes to use findings in legal proceedings, the Client is responsible for retaining their own legal counsel
  • Wise Forensic does not provide legal advice and nothing in the findings report should be construed as such

8. Indemnification

The Client agrees to indemnify, defend, and hold harmless AWRW Enterprises, LLC d/b/a Wise Forensic, its owner, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

  • The Client's misrepresentation of device ownership or authorization
  • The Client's misuse of the findings report or forensic data
  • Any third-party claims resulting from the Client's actions based on the findings
  • The Client's violation of any applicable law in connection with the engagement
  • Any inaccuracy in the information provided by the Client to Wise Forensic

9. Device Condition

Wise Forensic is not liable for any pre-existing conditions of the device, including but not limited to:

  • Hardware damage, malfunction, or degradation
  • Software corruption, malware, or system instability
  • Battery degradation or power issues
  • Data loss that occurred prior to Wise Forensic's involvement

While Wise Forensic takes all reasonable precautions to avoid causing harm to devices during forensic analysis, the Client acknowledges that some risk to device functionality exists and agrees not to hold Wise Forensic liable for incidental effects of the forensic process.

10. Severability

If any provision of this Waiver is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

11. Governing Law

This Waiver shall be governed by and construed in accordance with the laws of the State of Arizona. Any disputes arising under this Waiver shall be resolved in the courts of Maricopa County, Arizona.
