Privacy & Confidentiality Agreement

Effective Date

1. Commitment to Confidentiality

AWRW Enterprises, LLC d/b/a Wise Forensic ("Wise Forensic") is committed to protecting the privacy and confidentiality of all clients and the information obtained during forensic engagements. This Privacy & Confidentiality Agreement ("Agreement") outlines how Wise Forensic collects, uses, stores, and protects client information and forensic data.

2. Information Collected

In the course of providing forensic analysis services, Wise Forensic may collect and process the following types of information:

  • Client Information: Name, contact details, mailing address, and identification verification (ID is viewed for verification purposes only and is not retained or copied).
  • Device Information: Device type, make, model, serial number, IMEI, and operating system.
  • Forensic Data: Any data extracted from the examined device(s) as authorized by the Client via the applicable Consent Form or Parental Authorization Form.
  • Engagement Records: Service agreements, consent forms, and findings reports.

3. Use of Information

All information collected by Wise Forensic is used solely for the purpose of:

  • Performing the forensic analysis services requested by the Client
  • Preparing and delivering findings reports to the Client
  • Maintaining records of the engagement for Wise Forensic's internal business purposes
  • Complying with applicable legal obligations

Wise Forensic will never use client information or forensic data for marketing, advertising, or any purpose unrelated to the specific engagement.

4. No Disclosure to Third Parties

Wise Forensic will not disclose client information, forensic data, findings, or the existence of an engagement to any third party, except under the following circumstances:

  • Written Client Consent: The Client provides prior written authorization for specific disclosure.
  • Legal Requirement: Disclosure is required by applicable law, court order, or lawful subpoena.
  • Mandatory Reporting: Wise Forensic discovers evidence of child abuse, child sexual exploitation, child pornography, or child trafficking, which must be reported to appropriate authorities under Arizona law.

Mandatory Reporting Exception

Under Arizona law (A.R.S. Title 13, Chapter 35.1), Wise Forensic is obligated to report any discovered evidence of child abuse, child sexual exploitation, child pornography, or child trafficking to the appropriate authorities. This legal obligation supersedes all confidentiality commitments in this Agreement. Wise Forensic will notify the Client if such a report is made, to the extent permitted by law.

5. Data Retention

Wise Forensic follows strict data retention practices to minimize risk:

  • Forensic images and extracted data are permanently deleted within 30 calendar days of delivering the findings report to the Client, unless the Client provides written instructions to retain data for a longer period.
  • Findings reports are retained by Wise Forensic for a period of one (1) year for internal record-keeping, after which they are permanently deleted.
  • Engagement records (signed agreements, consent forms) are retained for a period of three (3) years for legal and business purposes.
  • The Client may request early deletion of forensic data at any time by providing written notice. Wise Forensic will confirm deletion in writing within 7 business days.

6. Data Security

Wise Forensic implements the following security measures to protect client data:

  • All forensic images and extracted data are stored on encrypted storage media (AES-256 encryption).
  • Forensic workstations are secured with full-disk encryption and strong authentication.
  • Data is never stored on cloud services, shared drives, or any internet-accessible storage.
  • Physical forensic media (external drives, USB devices) are stored in a secure, locked location when not in active use.
  • Findings reports delivered to the Client are transmitted via encrypted email or provided on encrypted media.

7. Client Responsibilities

The Client acknowledges and agrees to the following responsibilities:

  • Safeguarding any findings reports, forensic data, or information received from Wise Forensic.
  • Not publicly disclosing Wise Forensic's proprietary methods, tools, or techniques.
  • Notifying Wise Forensic immediately if the Client believes any confidential information has been compromised.
  • Using the information provided by Wise Forensic in a lawful and responsible manner.
